TO: Craigleith Summer Program, and its directors, officers, employees, instructors, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors, assigns and representatives (all of whom are hereinafter collectively referred to as the “Releasees”).

THE SPECIAL EVENT SPONSORS, and their directors, officers, employees, instructors, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors, assigns and representatives (all of whom are hereinafter collectively referred to as the “Releasees”).

ASSUMPTION OF RISKS

I am signing up as a member of the Craigleith Summer Program, and/or for a lesson or for any Activities by the Craigleith Summer Program voluntarily and at my own risk; and I am aware that the Activities (as defined above) and Summer Program (as defined above) and use of the Facilities involve many risks, dangers, and hazards, including but not limited to: changing weather conditions; exposed rock, earth and other natural objects; trees, tree wells, tree stumps and forest deadfall; variations in the terrain which may create blind spots or areas of reduced visibility; variable and difficult conditions; streams, creeks, and exposed holes in the terrain; cliffs; steepness and configuration of the terrain; steepness and condition of the hiking and mountain biking trails; injuries from hiking or mountain biking; collision with lift towers or fences, other vehicles, equipment or structures or objects or equipment used in connection with Special Events, Summer program or lessons, collision with other racers, spectators, participants, competitors, course officials, employees, volunteers, hikers, cyclists, tennis participants, or swimmers; loss of balance or control; falling while walking or running; water anywhere within the Facilities; encounters with domestic and wild animals including bears; EXPOSURE TO INFECTIOUS DISEASE CONTRACTED THROUGH VIRUSES, BACTERIA, PARASITES, AND FUNGI WHICH MAY BE TRANSMITTED THROUGH DIRECT OR INDIRECT CONTACT; negligent first aid; failure to act safely or within one’s own ability or to stay within designated areas; negligence of other hikers, cyclists, tennis participants, swimmers, and other persons; drowning; and RISKS RESULTING FROM THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY DUTY OF CARE ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM, OR WARN ME OF, THE RISKS, DANGERS AND HAZARDS. I am also aware and understand that the risk, dangers, and hazards referred to above exist in the Facilities and that many hazards are unmarked. In consideration of the opportunity to participate as a member of the Craigleith Summer Program and/or for a lesson or for any other Activities, I, for myself and for those I signed-up for (eg. partners and juniors), my heirs, executors and assigns, hereby waive, release and forever discharge and indemnify the Craigleith Summer Program, its organizers, volunteers, members and its Board from any and all damages, claims and actions for any loss, liability, claim, action, costs, expenses, physical or emotional injury or death to me arising out of my participation in this event or activity, howsoever caused. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my family, including child(ren), and I may be exposed to or infected by COVID-19 while on site and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Craigleith Summer Program may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the tennis and pool management company’s employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, my family and my child(ren) may experience or incur in connection with my child(ren)’s attendance at Craigleith Summer Program or participation in the Activities (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Craigleith Summer Program and their employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Craigleith Summer Program and their employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in Activities at the Facilities.
